1. Introduction
Welcome to CommunityInsightCentral ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at communityinsightcentral.xyz (the "Service") operated by CommunityInsightCentral.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
CommunityInsightCentral offers luxury yacht chartering services, including but not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private gatherings
- Extended charters
All services are contingent on availability and climatic conditions. We reserve the right to change or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht charter, you must:
- Be at least 18 years old
- Provide accurate and complete personal information
- Pay a deposit as outlined in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A booking becomes final upon our receipt of your payment and our issuance of written confirmation. We retain the right to decline service at our sole discretion.
3.3 Availability
Charter availability is subject to the state of our fleet and suitable weather conditions. We will strive to honor your preferred dates and times, within reason.
4. Payment Terms
4.1 Pricing
All pricing is listed in € and covers applicable taxes unless mentioned otherwise. Fee structures are subject to change without notice.
4.2 Payment Schedule
- Deposit: 50% of the entire cost due at the time of booking
- Remaining Balance: Payable 48 hours prior to the charter's departure
- Extra charges (if any): Due upon the charter's completion
4.3 Payment Methods
We accept the following methods of payment: major credit cards, bank transfers, and certified cheques. All payments are processed using secure, encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full reimbursement minus processing fees
- 24-72 hours before departure: 50% reimbursement
- Less than 24 hours before departure: Non-refundable
5.2 Weather Cancellations
Should unsafe weather conditions arise, as determined by our captain, we will propose to:
- Reschedule your charter at no extra cost to the next suitable date
- Issue a complete refund if rescheduling is impracticable
5.3 Mechanical Issues
If mechanical issues affect your designated vessel, we will endeavor to provide an acceptable alternative. Should no replacement be available, a full reimbursement will be offered.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Heed all commands from the crew
- Use safety equipment as necessary
- Disclose any health issues that could impact their safety
- Stay within designated areas on the yacht
6.2 Prohibited Objects
The following items are not permitted on board:
- Glasses and glass containers
- Unlawful materials
- Firearms or weapons
- Non-alcoholic beverages in excess of sensible consumption
- Pets (unless pre-authorized)
6.3 Behavior
Patrons must behave respectfully. We have the right to terminate a charter without reimbursement if a passenger's conduct poses a threat to safety or interferes with the enjoyment of others.
7. Liability and Insurance
7.1 Our Liability
Our liability is confined to the fees paid for your charter. We do not accept responsibility for:
- Injuries caused by passenger carelessness
- Loss or damage of personal belongings
- Peripheral, consequential, or penal damages
- Delays due to weather or situations beyond our control
7.2 Insurance Protection
We maintain broad insurance coverage for our vessels and operations. Charterers are accountable for their travel and personal insurance provisions.
7.3 Acceptance of Risk
By partaking in our chartered services, you agree to the inherent risks involved with maritime activities and take responsibility for your safety and welfare.
8. Modifications and Itinerary Changes
We reserve the right to alter itineraries, courses, or timetables due to weather events, security matters, or operational needs. Every attempt will be made to ensure equivalent alternative experiences.
9. Force Majeure
We disclaim any liability for postponements, annulations, or modifications due to force majeure, inclusive of:
- Extreme weather events
- Natural calamities
- Government legislations
- Port shutdowns
- Mechanical breakdowns
10. Privacy and Data Protection
Your personal data is treated according to our Privacy Policy. By utilizing our services, you consent to the collection and use of your details as elaborated in the Privacy Policy.
11. Intellectual Property
All materials on our webpage, such as text, visuals, logos, and pictures, are sealed by copyright and trademark ordinances. Replication, distribution, or creation of derivative works is prohibited without our explicit consent.
12. Governing Law
These Terms are prevailed upon by the laws applicable in Germany. Any disputes will be adjudicated in the courts located in Hamburg, Germany.
13. Changes to Terms
We have the discretion to adjust these Terms as needed. Alterations will be presented on our website with the date of the latest revision noted. Continued service usage denotes agreement to the revised terms.
